Robert Newcombe
Called in 1996.
Robert practices in both London and the
North East.
He undertakes publicly funded work for
individuals charged with grave offences and acts for corporate clients charged
with regulatory offences. He also undertakes a wide variety of civil work,
including landlord and tenant, planning, contractual disputes (including
construction), Enterprise Act enforcement proceedings, inquests and
extradition.
Recent lectures include:

(b) Criminal Justice Act 2003 Update;
(c) Obtaining Enforcement Orders under the Enterprise Act
Robert enjoys mastering the detail of
forensic expert witnesses and scientific and engineering evidence.
His approach to preparation translates
into cogent written advice, clear and logical drafting and advocacy which is
precise and persuasive.
Robert has recently undertaken one trial
as leading junior, represented an appellant in an appeal against conviction
(rape) and been lead by Queens Counsel in 5 murder/ manslaughter cases. Below is

R v N (2007) Central Criminal Court
- murder, lead by Tim Barnes QC – acquitted.
Defendant driving car when another on
rear seat bludgeoned deceased to death with hammer. Joint enterprise denied.
R v H (2006) Newcastle Crown Court- murder, lead by Paul
Sloan QC –
manslaughter by reason of provocation accepted on day of
trial.
R v D (2006) Newcastle Crown Court- importation of 95 kg
cannabis from Thailand
3 handed. Acquitted after previous conviction for similar
offence adduced by Crown.
R v G (2006) Nottingham Crown Court- s. 18 knifings, two
complainants
3 handed; Acquitted. Police Sergeant turning blind-eye to
racism on public transport.
R v Simmonds [2006] Court of Appeal- Appeal against murder
conviction dismissed; lead by Tim Barnes QC.
13 similar fact robberies on elderly victims in own homes. 83
year old murder victim. Head injury, delay before death.
Causation. Identity disputed at trial.
R v M (2005) Central Criminal Court-
murder, lead by Nigel Baker QC – acquitted.
Six handed street fight; cut throat
defences; bad character and hearsay arguments deployed against defendant.
R v S (2005) Inner London Crown
Court- firearms and class A drugs; leading junior.
Convicted; sentenced to 10 years for
possession of sub-machine pistol, 4 handguns, silencers, key-ring gun,
ammunition, 1 ½ kg heroin.
R v C (2005) Teesside Crown Court- £8m, 10 handed conspiracy
to defraud; (Copyright, Designs & Patents Act 1998).
Defendant allowed property to be used for storing infringing
copyright material produced by others and sold at car boot
sales. Guilty plea; 160 hours CPO.
R v Mitchell [2004] Court of Appeal- appeal against rape
conviction;
s. 41 YJCEA EWCA Crim 3206 1999; temporal provisions; dismissed.
R v C (2004) Central Criminal Court– rape. Acquitted.
15 year old boy alleged to have raped 9 year old half-sister:
confession excluded.
R v H (2004) Central Criminal Court– manslaughter, lead by
Nigel Rumfit QC.
Guilty plea. Administered heroin to friend who overdosed. 4
year sentence.
Robert has also defended in a number of
environmental prosecutions, and assisting solicitors in advising existing
business clients - including:
Water Resources Act 1991
Breach of planning enforcement
Waste management licensing
Depositing of controlled waste
(Environmental Protection Act 1990 and Waste Management Licensing Regulations)
End-of-life Vehicle Regulations
Remediation Notices.
Robert also undertakes advisory work
assisting solicitors and corporate clients with on-going requirements under
environmental, planning and health and safety legislation.
Robert was a member of the Territorial
Army between 1990 -1998. He is married with one daughter.
